What is the IAFF Guardian Policy?

Learn how the IAFF Guardian Policy provides legal representation for union leaders facing retaliation for union-related activities.

The IAFF Guardian Policy provides direct legal representation from the IAFF General Counsel to protect IAFF members who are subjected to retaliation for engaging in union-related activities or speaking out on matters of public concern.

The policy also supports targeted litigation that is expected to have a significant, precedent-setting impact on IAFF affiliates and members.

What the Guardian Policy is designed to protect

The Guardian Policy focuses on protecting core rights, including:

  • Freedom of speech

  • Freedom of association

  • Protection against retaliation for union activity

Public employers may not discipline, discharge, refuse to hire, or otherwise discriminate against employees for exercising their First Amendment rights or engaging in lawful union activity.

The Guardian Policy exists to defend those rights.

Who may qualify for Guardian Policy assistance?

Under IAFF policy, the General President may authorize legal assistance:

  • To Local union officers who have been disciplined in direct retaliation for union activities

  • To Locals pursuing targeted litigation expected to establish legal precedent benefiting other IAFF affiliates

Each request is reviewed individually in accordance with IAFF policy guidelines.

How to request Guardian Policy review

If you believe a matter may qualify:

  1. Contact your IAFF District Vice President.

  2. Provide relevant documentation and background information.

  3. Your District Vice President will advise on next steps under IAFF policy.

Important

The Guardian Policy does not provide general personal legal services unrelated to union activity or employment as a fire fighter or emergency medical worker.
