PRESUNCI\u00d3N REFUTABLE.  <\/p>\n<p><strong>\u00a7 408.006.<\/strong>  LESIONES POR TRAUMA MENTAL<\/p>\n<p>(b) No obstante la Secci\u00f3n 504.019, una [Una] lesi\u00f3n mental o emocional que surge principalmente de una acci\u00f3n de personal leg\u00edtima, incluyendo un traslado, ascenso, descenso de categor\u00eda o despido, no es una lesi\u00f3n compensable bajo este subt\u00edtulo.<\/p>\n<p>Actos de 2017, vigentes a partir del 1 de septiembre de 2017.<\/p>\n<p><strong>\u00a7 504.019<\/strong>. COBERTURA PARA TRASTORNO DE ESTR\u00c9S POSTRAUM\u00c1TICO PARA CIERTOS SOCORRISTAS. <br \/>(a) En esta secci\u00f3n:<\/p>\n<p style=\"padding-left: 40px;\">(1) \u201cSocorrista\u201d significa un individuo empleado por una subdivisi\u00f3n pol\u00edtica de este estado que es:<\/p>\n<p style=\"padding-left: 80px;\">(A) un agente de paz seg\u00fan el Art\u00edculo 2.12 del C\u00f3digo de Procedimiento Penal;<br \/>(B) una persona autorizada bajo el Cap\u00edtulo 773 del C\u00f3digo de Salud y Seguridad, como asistente de atenci\u00f3n de emergencia, t\u00e9cnico m\u00e9dico de emergencia, t\u00e9cnico m\u00e9dico de emergencia-intermedio, t\u00e9cnico m\u00e9dico de emergencia-param\u00e9dico o param\u00e9dico autorizado; o<br \/>(C) un bombero sujeto a certificaci\u00f3n por la Comisi\u00f3n de Protecci\u00f3n contra Incendios de Texas bajo el Cap\u00edtulo 419 del C\u00f3digo de Gobierno, cuyas funciones principales son la extinci\u00f3n de incendios y el rescate en accidentes de aeronaves.<\/p>\n<p style=\"padding-left: 40px;\">(2) \u00abTrastorno de estr\u00e9s postraum\u00e1tico\u00bb significa un trastorno que cumple con los criterios diagn\u00f3sticos para el trastorno de estr\u00e9s postraum\u00e1tico especificados por la Asociaci\u00f3n Psiqui\u00e1trica Americana en el Manual Diagn\u00f3stico y Estad\u00edstico de los Trastornos Mentales, quinta edici\u00f3n, o una edici\u00f3n posterior adoptada por el comisionado de compensaci\u00f3n de trabajadores.<\/p>\n<p>(b) El trastorno de estr\u00e9s postraum\u00e1tico sufrido por un socorrista es una lesi\u00f3n compensable bajo este subt\u00edtulo solo si se basa en un diagn\u00f3stico que:<\/p>\n<p style=\"padding-left: 40px;\">(1) el trastorno es causado por un evento que ocurre en el curso y alcance del empleo del socorrista; y<br \/>(2) la preponderancia de la evidencia indica que el evento fue un factor contribuyente sustancial del trastorno.<\/p>\n<p><strong>\u00a7 504.074<\/strong>. CUENTA DE AUTOSEGURO PARA BENEFICIOS POR FALLECIMIENTO Y BENEFICIOS DE INGRESOS VITALICIOS. <br \/>(a) Un consorcio o una subdivisi\u00f3n pol\u00edtica que se autoasegura puede establecer una cuenta para el pago de beneficios por fallecimiento y beneficios de ingresos vitalicios bajo el Cap\u00edtulo 408.<br \/>(b) Una cuenta establecida bajo esta secci\u00f3n puede acumular activos en una cantidad que el consorcio o subdivisi\u00f3n pol\u00edtica, a su entera discreci\u00f3n, determine necesaria para pagar beneficios por fallecimiento y beneficios de ingresos vitalicios. El establecimiento de una cuenta bajo esta secci\u00f3n o la cantidad de activos acumulados en la cuenta no afecta la responsabilidad de un consorcio o subdivisi\u00f3n pol\u00edtica por el pago de beneficios por fallecimiento y beneficios de ingresos vitalicios. <br \/>(c) El Cap\u00edtulo 2256 del C\u00f3digo de Gobierno no se aplica a la inversi\u00f3n de activos en una cuenta establecida bajo esta secci\u00f3n. Un consorcio o subdivisi\u00f3n pol\u00edtica que invierta o reinvierta los activos de una cuenta deber\u00e1 cumplir sus deberes \u00fanicamente en inter\u00e9s de los beneficiarios actuales y futuros: <\/p>\n<p style=\"padding-left: 40px;\">(1) para los prop\u00f3sitos exclusivos de:<\/p>\n<p style=\"padding-left: 80px;\">(A) proporcionar beneficios por fallecimiento y beneficios de ingresos vitalicios a los beneficiarios actuales y futuros; y<br \/>(B) sufragar los gastos razonables de administraci\u00f3n de la cuenta;<\/p>\n<p style=\"padding-left: 40px;\">(2) con el cuidado, habilidad, prudencia y diligencia bajo las circunstancias prevalecientes que una persona prudente actuando en una capacidad similar y familiarizada con asuntos del tipo utilizar\u00eda en la conducci\u00f3n de una empresa con un car\u00e1cter y objetivos similares;<br \/>(3) diversificando las inversiones de la cuenta para minimizar el riesgo de grandes p\u00e9rdidas, a menos que bajo las circunstancias sea claramente prudente no hacerlo; y<br \/>(4) de acuerdo con los documentos e instrumentos que rigen la cuenta en la medida en que los documentos e instrumentos sean consistentes con esta secci\u00f3n.<\/p>\n<p>(d) Al elegir y contratar servicios profesionales de gesti\u00f3n de inversiones para una cuenta establecida bajo esta secci\u00f3n y al continuar utilizando un gestor de inversiones, el grupo o la subdivisi\u00f3n pol\u00edtica debe actuar de manera prudente y en inter\u00e9s de los beneficiarios actuales y futuros de la cuenta.<\/p>\n<p><strong>\u00a7 607.052<\/strong>. APLICABILIDAD<br \/>(a) No obstante cualquier otra ley, este subcap\u00edtulo se aplica \u00fanicamente a un bombero o t\u00e9cnico de emergencias m\u00e9dicas que: <\/p>\n<p style=\"padding-left: 40px;\">(1) al ser empleado o durante su empleo como bombero o t\u00e9cnico de emergencias m\u00e9dicas, recibi\u00f3 un examen f\u00edsico que no revel\u00f3 evidencia de la enfermedad o dolencia por la cual se solicitan beneficios o compensaci\u00f3n utilizando una presunci\u00f3n establecida por este subcap\u00edtulo;<br \/>(2) est\u00e1 empleado durante cinco a\u00f1os o m\u00e1s como bombero o t\u00e9cnico de emergencias m\u00e9dicas; y<br \/>(3) solicita beneficios o compensaci\u00f3n por una enfermedad o dolencia cubierta por este subcap\u00edtulo que se descubre durante el empleo como bombero o t\u00e9cnico de emergencias m\u00e9dicas.<\/p>\n<p>(b) Una presunci\u00f3n bajo este subcap\u00edtulo no se aplica:<\/p>\n<p style=\"padding-left: 80px;\">(1) a la determinaci\u00f3n de la elegibilidad de un sobreviviente para beneficios bajo el Cap\u00edtulo 615;<br \/>(2) en una causa de acci\u00f3n presentada en un tribunal estatal o federal, excepto para la revisi\u00f3n judicial de un procedimiento en el que se haya otorgado o denegado beneficios o compensaci\u00f3n relacionados con el empleo;<br \/>(3) a una determinaci\u00f3n con respecto a beneficios o compensaci\u00f3n bajo una p\u00f3liza de seguro de vida o discapacidad adquirida por o en nombre del bombero o t\u00e9cnico de emergencias m\u00e9dicas<br \/>que proporcione cobertura adicional a cualquier beneficio o compensaci\u00f3n requerida por la ley; o<br \/>(4) si se sabe que la enfermedad o dolencia por la cual se solicitan beneficios o compensaci\u00f3n es causada por el uso de tabaco y:<\/p>\n<p style=\"padding-left: 120px;\">(A) el bombero o t\u00e9cnico de emergencias m\u00e9dicas es o ha sido consumidor de tabaco; o<br \/>(B) el c\u00f3nyuge del bombero o t\u00e9cnico de emergencias m\u00e9dicas ha sido, durante el matrimonio, consumidor de tabaco que se consume mediante el acto de fumar.<\/p>\n<p>(c) Este subcap\u00edtulo no crea una causa de acci\u00f3n.<br \/>(d) Este subcap\u00edtulo no ampl\u00eda ni establece un derecho a ning\u00fan beneficio o compensaci\u00f3n o elegibilidad para ning\u00fan beneficio o compensaci\u00f3n.<br \/>(e) Un bombero o t\u00e9cnico de emergencias m\u00e9dicas que utiliza una presunci\u00f3n establecida bajo este subcap\u00edtulo tiene derecho \u00fanicamente a los beneficios o compensaci\u00f3n a los que el bombero o t\u00e9cnico de emergencias m\u00e9dicas tendr\u00eda derecho a recibir en el momento en que se presenta la reclamaci\u00f3n de beneficios o compensaci\u00f3n.<br \/>(f) A los efectos de este subcap\u00edtulo, un individuo descrito en la Secci\u00f3n 607.051(3)(B) se considera empleado o compensado mientras el individuo sirve activamente como bombero voluntario. Un individuo que sirve activamente como bombero voluntario es aquel que participa en un m\u00ednimo del 40 por ciento de los simulacros realizados por el departamento del individuo y el 25 por ciento de los incendios u otras llamadas de emergencia recibidas por el departamento durante el tiempo que el bombero voluntario est\u00e1 de guardia. <br \/>(g) Este subcap\u00edtulo se aplica a un bombero o t\u00e9cnico de emergencias m\u00e9dicas que presta servicios como empleado de una entidad creada por un acuerdo interlocal.<br \/>(h) El inciso (b)(4) solo impide la aplicaci\u00f3n de la presunci\u00f3n autorizada por este subcap\u00edtulo y no afecta el derecho de un bombero o t\u00e9cnico de emergencias m\u00e9dicas a proporcionar pruebas, sin el uso de esa presunci\u00f3n, de que una lesi\u00f3n o enfermedad ocurri\u00f3 durante el curso y alcance del empleo.<\/p>\n<p><strong>\u00a7 607.053<\/strong>. INMUNIZACI\u00d3N; VIRUELA. <\/p>\n<p>(a) Se presume que un bombero o t\u00e9cnico de emergencias m\u00e9dicas ha sufrido una discapacidad o muerte durante el curso y alcance del empleo si el bombero o t\u00e9cnico de emergencias m\u00e9dicas:<\/p>\n<p style=\"padding-left: 40px;\">(1) recibi\u00f3 inmunizaci\u00f3n preventiva contra la viruela, u otra enfermedad a la que el bombero o t\u00e9cnico de emergencias<br \/>m\u00e9dicas pueda estar expuesto durante el curso y alcance del empleo y para la cual la inmunizaci\u00f3n es posible; y<br \/>(2) sufri\u00f3 muerte o discapacidad total o parcial como resultado de la inmunizaci\u00f3n.<\/p>\n<p>(b) Una inmunizaci\u00f3n descrita en esta secci\u00f3n se considera preventiva ya sea que la inmunizaci\u00f3n ocurra antes o despu\u00e9s de la exposici\u00f3n a la enfermedad para la cual se prescribe la inmunizaci\u00f3n.<br \/>(c) Una presunci\u00f3n establecida bajo el Inciso (a) no puede ser refutada por evidencia de que la inmunizaci\u00f3n:<\/p>\n<p style=\"padding-left: 40px;\">(1) no fue requerida por el empleador;<br \/>(2) no fue requerida por la ley; o<br \/>(3) fue recibida voluntariamente o con el consentimiento del bombero o t\u00e9cnico de emergencias m\u00e9dicas.<\/p>\n<p>(d) Se presume que un bombero o t\u00e9cnico de emergencias m\u00e9dicas que sufre de viruela que resulta en muerte o discapacidad total o parcial ha contra\u00eddo la enfermedad durante el curso y alcance del empleo como bombero o t\u00e9cnico de emergencias m\u00e9dicas.<\/p>\n<p><strong>\u00a7 607.054<\/strong>. TUBERCULOSIS U OTRA ENFERMEDAD RESPIRATORIA. <\/p>\n<p>Un bombero o t\u00e9cnico m\u00e9dico de emergencia que padece tuberculosis, o cualquier otra enfermedad o dolencia de los pulmones o del tracto respiratorio que tenga una correlaci\u00f3n estad\u00edsticamente positiva con el servicio como bombero o t\u00e9cnico m\u00e9dico de emergencia, que resulte en muerte o discapacidad total o parcial, se presume que ha contra\u00eddo la enfermedad o dolencia durante el curso y alcance de su empleo como bombero o t\u00e9cnico m\u00e9dico de emergencia.<\/p>\n<p><strong>\u00a7 607.055<\/strong>. C\u00c1NCER. <\/p>\n<p>(a) Se presume que un bombero o t\u00e9cnico m\u00e9dico de emergencia que padece c\u00e1ncer resultando en muerte o discapacidad total o parcial ha desarrollado el c\u00e1ncer durante el curso y alcance de su empleo como bombero o t\u00e9cnico m\u00e9dico de emergencia si:<\/p>\n<p style=\"padding-left: 40px;\">(1) el bombero o t\u00e9cnico m\u00e9dico de emergencia:<\/p>\n<p style=\"padding-left: 80px;\">(A) respondi\u00f3 regularmente en la escena a llamadas que involucraban incendios o combate de incendios; o<br \/>(B) respondi\u00f3 regularmente a un evento que involucraba la liberaci\u00f3n documentada de radiaci\u00f3n o un carcin\u00f3geno conocido o sospechoso mientras la persona estaba empleada como bombero o t\u00e9cnico m\u00e9dico de emergencia; y<\/p>\n<p style=\"padding-left: 40px;\">(2) el c\u00e1ncer est\u00e1 descrito en la Subsecci\u00f3n (b).<\/p>\n<p>(b) Esta secci\u00f3n se aplica \u00fanicamente a:<\/p>\n<p style=\"padding-left: 40px;\">(1) c\u00e1ncer que se origina en el est\u00f3mago, colon, recto, piel, pr\u00f3stata, test\u00edculo o cerebro;<br \/>(2) linfoma no Hodgkin;<br \/>(3) mieloma m\u00faltiple;<br \/>(4) melanoma maligno; y<br \/>(5) carcinoma de c\u00e9lulas renales<\/p>\n<p><strong>\u00a7 607.056<\/strong>. INFARTO AGUDO DE MIOCARDIO O ACCIDENTE CEREBROVASCULAR. <\/p>\n<p>(a) Se presume que un bombero o t\u00e9cnico m\u00e9dico de emergencia que sufre un infarto agudo de miocardio o un accidente cerebrovascular que resulta en discapacidad o<br \/>muerte ha sufrido la discapacidad o muerte durante el curso y alcance de su empleo como bombero o t\u00e9cnico<br \/>m\u00e9dico de emergencia si:<\/p>\n<p style=\"padding-left: 40px;\">(1) mientras estaba en servicio, el bombero o t\u00e9cnico m\u00e9dico de emergencia:<\/p>\n<p style=\"padding-left: 80px;\">(A) estaba involucrado en una situaci\u00f3n que implicaba actividad f\u00edsica estresante o extenuante no rutinaria relacionada con la<br \/>supresi\u00f3n de incendios, rescate, respuesta a materiales peligrosos, servicios m\u00e9dicos de emergencia u otra actividad de respuesta a emergencias; o<br \/>(B) particip\u00f3 en un ejercicio de entrenamiento que involucraba actividad f\u00edsica estresante o extenuante no rutinaria; y<\/p>\n<p style=\"padding-left: 40px;\">(2) el infarto agudo de miocardio o el accidente cerebrovascular ocurri\u00f3 mientras el bombero o t\u00e9cnico m\u00e9dico de emergencia estaba realizando la actividad descrita en la Subdivisi\u00f3n (1).<\/p>\n<p>(b) Para los prop\u00f3sitos de esta secci\u00f3n, \u201cactividad f\u00edsica estresante o extenuante no rutinaria\u201d no incluye actividades administrativas, de oficina o no manuales.<\/p>\n<p><strong>\u00a7 607.057<\/strong>. EFECTO DE LA PRESUNCI\u00d3N. <\/p>\n<p>Excepto lo dispuesto en la Secci\u00f3n 607.052(b), una presunci\u00f3n establecida bajo este subcap\u00edtulo se aplica a la determinaci\u00f3n de si la discapacidad o muerte de un bombero o t\u00e9cnico m\u00e9dico de emergencia result\u00f3 de una enfermedad o dolencia contra\u00edda en el curso y alcance del empleo para fines de beneficios o compensaci\u00f3n proporcionados bajo otro beneficio, ley o plan de empleados, incluido un plan de pensiones.<\/p>\n<p><strong>\u00a7 607.058<\/strong>. PRESUMPTION REBUTTABLE.\n\n<strong>\u00a7 408.006.<\/strong>  MENTAL TRAUMA INJURIES\n\n(b)  Notwithstanding Section 504.019, a [A] mental or emotional injury that arises principally from a legitimate personnel action, including a transfer, promotion, demotion, or termination, is not a compensable injury under this subtitle.\n  \t            \nActs 2017, effective September 1, 2017.\n \t\t       \n<strong>\u00a7 504.019.<\/strong>  COVERAGE FOR POST-TRAUMATIC STRESS DISORDER FOR CERTAIN FIRST RESPONDERS. \n(a) In this section:\n  \t             \n     (1) \"First responder\" means an individual employed by a political subdivision of this state who is:\n  \t     \n\t(A) a peace officer under Article 2.12, Code of Criminal Procedure;\n\t(B) a person licensed under Chapter 773, Health and Safety Code, as an \t        emergency care attendant, emergency medical technician, emergency medical \t        technician-intermediate, emergency medical technician-paramedic, or licensed \t        paramedic; or\n\t(C) a firefighter subject to certification by the Texas Commission on Fire \tProtection under Chapter 419, Government Code, whose principal duties are \tfirefighting and aircraft crash and rescue.\n  \t             \n     (2) \"Post-traumatic stress disorder\" means a disorder that meets the diagnostic criteria for post-traumatic stress disorder specified by the American Psychiatric Association in the Diagnostic and Statistical Manual of Mental Disorders, fifth edition, or a later edition adopted by the commissioner of workers' compensation.\n  \t\n(b) Post-traumatic stress disorder suffered by a first\tresponder is a compensable injury under this subtitle only if it is based on a diagnosis that:\n\n     (1)  the disorder is caused by an event occurring in the course and scope of the first responder's employment; and\n     (2)  the preponderance of the evidence indicates that the event was a substantial contributing factor of the disorder.\n\n<strong>\u00a7 504.074.<\/strong> SELF-INSURANCE ACCOUNT FOR DEATH BENEFITS AND LIFETIME INCOME BENEFITS. \n\t(a) A pool or a political subdivision that self-insures may establish an account for the payment of death benefits and lifetime income benefits under Chapter 408.\n\t(b) An account established under this section may accumulate assets in an amount that the pool or political subdivision, in its sole discretion, determines is necessary in order to pay death benefits and lifetime income benefits. The establishment of an account under this section or the amount of assets accumulated in the account does not affect the liability of a pool or political subdivision for the payment of death benefits and lifetime income benefits.\n\t(c) Chapter 2256, Government Code, does not apply to the investment of assets in an account established under this section. A pool or political subdivision investing or reinvesting the assets of an account shall discharge its duties solely in the interest of current and future beneficiaries:\n\t\t(1) for the exclusive purposes of:\n\t\t\t(A) providing death benefits and lifetime income benefits to current and future beneficiaries; and\n\t\t\t(B) defraying reasonable expenses of administering the account;\n\t\t(2) with the care, skill, prudence, and diligence under the prevailing circumstances that a prudent person acting in a like capacity and familiar with matters of the type would use in the conduct of an enterprise with a like character and like aims;\n\t\t(3) by diversifying the investments of the account to minimize the risk of large losses, unless under the circumstances it is clearly prudent not to do so; and\n\t\t(4) in accordance with the documents and instruments governing the account to the extent that the documents and instruments are consistent with this section.\n\t(d) In choosing and contracting for professional investment management services for an account established under this section and in continuing the use of an investment manager, the pool or political subdivision must act prudently and in the interest of the current and future beneficiaries of the account.\n\n<strong>\u00a7 607.052.<\/strong>  APPLICABILITY \n(a)  Notwithstanding any other law, this subchapter applies only to a firefighter or emergency medical technician who:\n\t(1)  on becoming employed or during employment as a firefighter or emergency medical technician, received a physical examination that failed to reveal evidence of the illness or disease for which benefits or compensation are sought using a presumption established by this subchapter;\n\t(2)  is employed for five or more years as a firefighter or emergency medical technician; and\n\t(3)  seeks benefits or compensation for a disease or illness covered by this subchapter that is discovered during  employment as a firefighter or emergency medical technician.\n(b)  A presumption under this subchapter does not apply:                       \n\t(1)  to a determination of a survivor's eligibility for benefits under Chapter 615;\n\t(2)  in a cause of action brought in a state or federal court except for judicial review of a proceeding in which there has  been a grant or denial of employment-related benefits or compensation;\n\t(3)  to a determination regarding benefits or  compensation under a life or disability insurance policy purchased by or on behalf of the firefighter or emergency medical technician \nthat provides coverage in addition to any benefits or compensation required by law; or\n\t(4)  if the disease or illness for which benefits or compensation is sought is known to be caused by the use of tobacco and:\n\t\t(A)  the firefighter or emergency medical technician is or has been a user of tobacco; or\n\t\t(B)  the firefighter's or emergency medical technician's spouse has, during the marriage, been a user of tobacco that is consumed through smoking.\n(c)  This subchapter does not create a cause of action.                        \n(d)  This subchapter does not enlarge or establish a right to any benefit or compensation or eligibility for any benefit or compensation.\n(e)  A firefighter or emergency medical technician who uses a presumption established under this subchapter is entitled only to the benefits or compensation to which the firefighter or emergency medical technician would otherwise be entitled to receive at the time the claim for benefits or compensation is filed.\n(f)  For purposes of this subchapter, an individual described by Section 607.051(3)(B) is considered to have been employed or compensated while the individual actively served as a volunteer firefighter.  An individual who actively serves as a volunteer firefighter is one who participates in a minimum of 40 percent of the drills conducted by the individual's department and 25 percent of the fire or other emergency calls received by the department during the time that the volunteer firefighter is on call.\n(g)  This subchapter applies to a firefighter or emergency medical technician who provides services as an employee of an entity created by an interlocal agreement.\n(h)  Subsection (b)(4) only prevents the application of the presumption authorized by this subchapter and does not affect the right of a firefighter or emergency medical technician to provide proof, without the use of that presumption, that an injury or illness occurred during the course and scope of employment.\n\n<strong>\u00a7 607.053.<\/strong>  IMMUNIZATION; SMALLPOX.  \n\n(a)  A firefighter or emergency medical technician is presumed to have suffered a disability or death during the course and scope of employment if the firefighter or emergency medical technician:\n\t(1)  received preventative immunization against smallpox, or another disease to which the firefighter or emergency \nmedical technician may be exposed during the course and scope of employment and for which immunization is possible; and\n\t(2)  suffered death or total or partial disability as a result of the immunization.\n(b)  An immunization described by this section is considered preventative whether the immunization occurs before or after exposure to the disease for which the immunization is prescribed.\n(c)  A presumption established under Subsection (a) may not be rebutted by evidence that the immunization was:\n\t(1)  not required by the employer;                                            \n\t(2)  not required by law; or                                                  \n\t(3)  received voluntarily or with the consent of the firefighter or emergency medical technician.\n(d)  A firefighter or emergency medical technician who suffers from smallpox that results in death or total or partial disability is presumed to have contracted the disease during the course and scope of employment as a firefighter or emergency medical technician.\n\n<strong>\u00a7 607.054.<\/strong>  TUBERCULOSIS OR OTHER RESPIRATORY ILLNESS.  \n\nA firefighter or emergency medical technician who suffers from tuberculosis, or any other disease or illness of the lungs or respiratory tract that has a statistically positive correlation with service as a firefighter or emergency medical technician, that results in death or total or partial disability is presumed to have contracted the disease or illness during the course and scope of employment as a firefighter or emergency medical technician.\n\n<strong>\u00a7 607.055.<\/strong>  CANCER.  \n\n(a)  A firefighter or emergency medical technician who suffers from cancer resulting in death or total or partial disability is presumed to have developed the cancer during the course and scope of employment as a firefighter or emergency medical technician if:\n\t(1)  the firefighter or emergency medical technician:                         \n\t\t(A)  regularly responded on the scene to calls involving fires or fire fighting; or\n\t\t(B)  regularly responded to an event involving the documented release of radiation or a known or suspected carcinogen while the person was employed as a firefighter or emergency medical technician; and\n\t(2)  the cancer is described by Subsection (b).\n(b)  This section applies only to:\n\t(1) cancer that originates at the stomach, colon, rectum, skin, prostate, testis, or brain;\n\t(2) non-Hodgkin's lymphoma;\n\t(3) multiple myeloma;\n\t(4) malignant melanoma; and\n\t(5) renal cell carcinoma\n \n<strong>\u00a7 607.056.<\/strong>  ACUTE MYOCARDIAL INFARCTION OR STROKE.  \n\n(a)  A firefighter or emergency medical technician who suffers an acute myocardial infarction or stroke resulting in disability or \ndeath is presumed to have suffered the disability or death during the course and scope of employment as a firefighter or emergency \nmedical technician if:\n\t(1)  while on duty, the firefighter or emergency medical technician:        \n\t\t(A)  was engaged in a situation that involved nonroutine stressful or strenuous physical activity involving fire \nsuppression, rescue, hazardous material response, emergency medical services, or other emergency response activity; or\n\t\t(B)  participated in a training exercise that involved nonroutine stressful or strenuous physical activity; and\n\t(2)  the acute myocardial infarction or stroke occurred while the firefighter or emergency medical technician was engaging in the activity described under Subdivision (1).\n(b)  For purposes of this section, \"nonroutine stressful or strenuous physical activity\" does not include clerical, administrative, or nonmanual activities.\n\n<strong>\u00a7 607.057.<\/strong>  EFFECT OF PRESUMPTION.  \n\nExcept as provided by Section 607.052(b), a presumption established under this subchapter applies to a determination of whether a firefighter's or emergency medical technician's disability or death resulted from a disease or illness contracted in the course and scope of employment for purposes of benefits or compensation provided under another employee benefit, law, or plan, including a pension plan.\n\n<strong>\u00a7 607.058.<\/strong>  PRESUMPTION REBUTTABLE.  \n\n\t(a) A presumption under Section 607.053, 607.054, 607.055, or 607.056 may be rebutted through a showing by a preponderance of the evidence that a risk factor, accident, hazard, or other cause not associated with the individual's service as a firefighter or emergency medical technician was a substantial factor in bringing about the individual's disease or illness, without which the disease or illness would not have occurred.\n\t(b) A rebuttal offered under this section must include a statement by the person offering the rebuttal that describes, in detail, the evidence that the person reviewed before making the determination that a cause not associated with the individual's service as a firefighter or emergency medical technician was a substantial factor in bringing about the individual's disease or illness, without which the disease or illness would not\nhave occurred.\n\t(c) In addressing an argument based on a rebuttal offered under this section, an administrative law judge shall make findings of fact and conclusions of law that consider whether a qualified expert, relying on evidence-based medicine, stated the opinion that, based on reasonable medical probability, an identified risk\nfactor, accident, hazard, or other cause not associated with the individual's service as a firefighter or emergency medical technician was a substantial factor in bringing about the individual's disease or illness, without which the disease or illness would not have occurred.<\/pre>\n<\/div>\n<\/div>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>PARTE DEL C\u00d3DIGO: Estatutos de TexasC\u00f3digo laboral T\u00cdTULO 5.
