Rumors are continuing that Presidentt Obama will make his Supreme Court nomination announcement today, and that it will be Elena Kagan, the current Solicitor General. Meanwhile, Orrin Hatch, a Republican Senator and ranking member of the minority party on the Judiciary Committee, has voiced support for Merrick Garland, a federal D.C. Circuit Judge. He remains the dark horse in this process. Kagan is a safe and uncontroversial choice (as would be Garland, who will be on the next short list if he doesn’t get picked today).
Both individuals are solid on fire fighter issues, although there’s more of a record to go on with respect to Garland. On overtime for public employees, collective bargaining, the First Amendment, and government transparency (FOIA), both nominees have strong records.
