New
Fair Labor Standards Act Manual Available to Affiliates
June 18, 2010 -- The IAFF General Counsel’s Office and the
General Counsel’s firm, Woodley & McGillivary, have completed a review and
thorough update of the IAFF Fair Labor Standards Act (FLSA) Manual. That Manual
was last reviewed and updated by Woodley & McGillivary attorneys in 1996. It has
long provided IAFF affiliate leaders detailed analysis on various FLSA issues
and principles.
Woodley & McGillivary attorneys reviewed every page and detail of the new
Manual, added several sections and additional content, including:
• A complete overhaul and review of the section 7(k) and 3(y) partial exemption
• Analysis of 2004 regulations on the so-called “white collar” exemptions
• A new chapter on FLSA rights for federal employees
• Updated cases and tables of relevant statutes
• Summaries on 14 years of additional case law
• Litigation and bargaining tips
• Explanation of potential constitutional challenges
The Manual will be available on the
IAFF web site for affiliate
leaders (log in required) in PDF format only. Because of the size of the Manual
and cost of reproduction, hardbound copies are not bring printed. However,
affiliates can take the file to a local print shop to print a copy.
